1. Acceptance of Terms

By accessing or using MagiTeacher, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must not use the service.

2. Description of Service and Credits

MagiTeacher is an AI-powered pedagogical assistant. Our services are provided through a credit system:

• Free Tier: 5 credits per month (no credit card required).
• Paid Tiers: Monthly subscription plans offering 100 or 300 credits.
• Top-up Option: Subscribers on paid plans can purchase Top-up Packs of 50 credits whenever their balance reaches 20 credits or fewer.
• The "Fixed Reset" Policy: At the start of each new billing cycle, your credit balance will automatically reset to the fixed amount of your chosen plan (100 or 300 credits).
• No Rollover: Any unused credits from the monthly plan OR from Top-up packs do not roll over to the next month. All remaining credits expire at the end of your current billing cycle. No compensation or refunds are provided for expired credits.

3. Payments and No-Refund Policy

All paid subscriptions are billed on a monthly basis. Due to the digital nature of the AI-generated content and the availability of a Free Tier for testing:

• All sales are final.
• By using your first credit in a paid billing cycle, you explicitly waive your statutory right to a 14-day cooling-off period, as the service is performed immediately upon credit consumption.

4. Intellectual Property and Usage Licence

MagiTeacher grants you a limited, personal, and non-transferable licence to use the generated content:

• Personal Use Only: Content is strictly for use with your own students in a classroom or tutoring environment.
• No Reselling: You are strictly prohibited from reselling, sublicensing, or uploading generated materials to commercial marketplaces (e.g., Teachers Pay Teachers) or any other platform for financial gain.

5. AI Content Accuracy and "Duty to Review"

You acknowledge that MagiTeacher uses Artificial Intelligence, which may occasionally produce inaccurate or biased information (hallucinations):

• Mandatory Review: As an educator, you have the absolute professional duty to review and verify all generated content before using it with students.
• No Liability: MagiTeacher is not responsible for any pedagogical errors or negative educational outcomes resulting from the use of unverified AI content.

6. Student Privacy and Prohibited Inputs

To protect student data and comply with global privacy laws (GDPR/COPPA):

• No Personal Data: You are forbidden from inputting names, IDs, or any identifiable information regarding your students into the AI prompts.
• Anonymisation: You must use fictitious names or generic descriptors (e.g., "Student A"). MagiTeacher is not liable for privacy breaches caused by your input of sensitive data.

7. Service Availability and Third-Party Providers

MagiTeacher is provided on an "as is" and "as available" basis:

• Dependencies: We depend on third-party AI models and cloud providers. We are not liable for temporary service interruptions or downtime caused by these providers.
• Maintenance: We reserve the right to modify or suspend the service for updates or maintenance at any time.

8. Termination of Use

MagiTeacher reserves the right to suspend or terminate your account immediately, without notice, if you breach these terms.

9. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Ireland. Any legal disputes or claims arising from the use of MagiTeacher shall be settled exclusively in the courts of Ireland.
